Please read the following Auction Procedures and Conditions of Sale closely.

By placing a bid in this sale, you acknowledge and agree that you are bound by these Auction Procedures and Conditions of Sale.

 AUCTION REGISTRATION

You must register in order to bid in this auction before 4:00PM PST (7:00PM EST) on SATURDAY, JANUARY 20TH, 2018. If you have registered for a previous SCP internet auction, please use your previously established login and password to bid in this auction. Auction registration takes only a few moments. Please log on to www.scpauctions.com and click on the “Registration” tab. Please enter all of the required registration information and click “Save” at the bottom of the page. During registration, you will create a login and password. You will only need to register once for this auction. You must be logged-in at www.scpauctions.com in order to place bids. Keep your login and password in a safe place for future reference, as they will remain your login and password for all future SCP internet auctions. Upon registering, you will receive an email confirming your registration. At our sole discretion and for any reason, SCP Auctions retains the right to revoke an account and any bids previously placed by that account. In the event that an account and any bids are revoked, the account holder will be notified by phone and/or email. BIDDING

(PLEASE NOTE CHANGE TO SCP AUCTIONS CLOSING PROCEDURE)

This is an internet-only auction.  All items that meet reserve are sold to the highest bidder. Bidding for all lots for this auction will open on MONDAY, JANUARY 8TH, 2018 at www.scpauctions.com. Immediately after registering and receiving email confirmation of your login and password (see REGISTRATION above), you will be able to bid in this sale. You must be logged-in to the auction at www.scpauctions.com using your log-in and your password in order to place bids in this sale. In order to be eligible to bid on a lot during the Extended Bidding Period which begins at 5:00pm PST on JANUARY 20TH (the final day), you must have placed a bid on that lot before the end of the Initial Bidding Period (before 5:00pm PST on SATURDAY, JANUARY 20TH). IF YOU HAVE NOT BID ON THE LOT BEFORE 5:00PM PST (8:00PM EST) ON SATURDAY, JANUARY 20TH, YOU CANNOT BID ON THE LOT AFTER 5:00PM PST (8:00PM EST).

 

EXTENDED BIDDING PERIOD

IMPORTANT: EXTENDED BIDDING PROCEDURE:  30 Minute Ending: Starting at 5:00 PM PT (8:00 PM ET) on Saturday, January 20th, any person who has bid on the lot previously may continue to bid on the lot. At this point no new bidders will be allowed to bid.  Bidding will continue until there are no more bids for 30 minutes.  For example, if a bid is placed at 8:15, the new end time for the lot would become 8:45. If no other bids are placed before 8:45, the lot will close. If you are the high bidder on the lot, changing your bid will not extend the bidding during the 30 Minute Ending phase (only a bid from another bidder will extend bidding). Please get your initial bids in as early as possible before the extended bidding period to avoid getting shut out of the auction.

The Extended Bidding Period will apply to all lots that have received two or more bids above the Minimum Bid during the Initial Bidding Period. The Extended Bidding Period begins on SATURDAY, JANUARY 20TH at 5:00PM Pacific Standard Time (8:00PM Eastern Standard Time). During Extended Bidding you are only eligible to bid on items that you have previously placed bids on.

AUCTION CLOSING

30 Minute Ending: Starting at 5:00 PM PT (8:00 PM ET) on Saturday, January 20th, any person who has bid on the lot previously may continue to bid on the lot. At this point no new bidders will be allowed to bid.  Bidding will continue until there are no more bids for 30 minutes.  For example, if a bid is placed at 8:15, the new end time for the lot would become 8:45. If no other bids are placed before 8:45, the lot will close.

HAMMER PRICE AND THE BUYER’S PREMIUM

The bid amounts placed in this sale at www.scpauctions.com are sometimes also referred to as the hammer prices. A Buyer’s Premium will be added to the winning bid or hammer price and is payable by the purchaser as part of the total purchase price. The Buyer’s Premium is equal to 20% of the winning bid price. For example, in the event that you win a lot with a successful bid price (hammer price) of $1,000, then your total cost for that lot will be equal to the $1,000 successful bid price plus the 20% Buyer’s Premium. In this example, the total cost for that lot will equal $1,200 (plus shipping, handling, insurance, and California sales tax if applicable).

 

INVOICING

Invoices will be emailed to all winning bidders. Invoices are also available online. To view your invoice, log-in to the “My Accounts” page and click on the “View Invoice” button. Invoices are due and payable by THURSDAY, FEBRUARY 1st, 2018. Shipping, packing, insurance, and California sales tax (if applicable) will be included on the invoice. State sales tax will be charged to residents of California unless you provide a valid California tax resale number. If you have a valid California resale license, you will have the opportunity to check the appropriate box when registering for the auction on-line. You must also fax a copy of your valid California resale license to Fax +1 (949) 643-2800 with a cover letter that includes your name, account name and telephone number. We will then mail you a California re-sale certificate which you must complete, sign and mail back to SCP Auctions. If you check the re-sale box online during registration, but do not provide us with a copy of your California resale number and return the certificate to SCP Auctions, we are required to collect and remit sales tax.

 

PAYMENT:  CREDIT CARDS ARE NOT ACCEPTED

Payment may be in the form of personal or business checks, certified checks, traveler checks, money orders, or wire transfers. All payments must clear prior to items being shipped. Property will not be released to you, your agent, or a shipper for up to seven business days in order to allow payment to clear. Payment must be mailed to SCP Auctions, 32451 Golden Lantern, Suite 308, Laguna Niguel, CA  92677. For Wire Transfers: please include your account name and lot numbers purchased as the “additional information” that you may provide when sending the wire transfer.

 

SHIPPING 

Payment for your invoice must clear in full prior to shipping. All items will be shipped from SCP Auctions California offices in the order that payments are received. Please allow up to three business days following clearance of payment for items to ship. All items will be shipped UPS Ground unless you contact us to discuss an alternative shipping method. If you would like your items shipped in a different method, such as UPS Next Day or UPS 2-Day, you must contact Dave Johnson, Shipping Manager at DJohnson@scpauctions.com prior to discuss alternative shipping instructions. Prior to bidding, please be aware of estimated shipping costs, especially for large or heavy lots. You may contact SCP Auctions for any shipping estimates for lots.  If you intend to pick up your items in person at SCP Auction’s California office, please call SCP Auctions to schedule. Payment must clear prior to items being available for pick-up.

 

FRAMES INCLUDED WITH LOTS

While we make every effort to protect the frames included with these lots during pre-auction storage and post auction shipping, we are not responsible for any damage to the frames themselves, and no refunds will be given due to frame damage.

If you have been an active bidder in SCP Auctions during the last three years, you will continue to receive our complimentary auction catalogues. If you have not been an active bidder in our auctions and do not participate in this auction we will be removing your name from our complimentary catalogue list. CONDITIONS OF SALE

 

BIDDING

By placing a bid with SCP Auctions you are entering in to a legal and binding contract. No bid may be retracted under any circumstances. In the event of a disagreement regarding bids, the determination of SCP shall be final.

 

CAPITALIZED HEADINGS & LOT DESCRIPTIONS

The Capitalized (Bold) Heading is included in the printed catalogue for each lot. In addition to the Capitalized Heading, the on-line catalogue includes a detailed lot description for each lot. It is important to read the detailed lot description for a complete description of the contents, conditions, quantities, and details of each lot. Please call with questions prior to placing a bid on any lot.

 

ADDITIONAL TERMS

The title to each lot will remain with SCP Auctions or the Consignor until payment has cleared. SCP Auctions retains the right to withdraw any item in the sale prior to the closing date of the sale for any reason whatsoever and shall have no liability for such withdrawal. Any necessary corrections to the printed catalogue shall be published in the Addenda on-line. All capitalized heading and lot description references to PSA population reports, SMR values, and PSA set registry rankings are as of the time that this catalogue was produced. SCP Auctions retains the right to cancel any sale if payment is not received within 30 days following the closing date of the auction. SCP Auctions retains the right to revoke future bidding privileges for accounts that are not paid in full within 30 days following the closing date of the auction. If a winning bidder does not pay an invoice in full within 30 days following the closing of the auction, SCP Auctions retains the right to cancel the sale and return the items to the consignor(s), sell the given items to an under-bidder, re-offer the item(s) in subsequent auction(s) or for private sale, or any other means of disposal. SCP Auctions retains the right to post-pone or delay the auction for any reason including for reasons beyond their control, without recourse from any account holder or bidder. By bidding in this auction, the bidder consents to the application of the laws of the state of California without application of conflicts of laws and the jurisdiction of the state of California in the county of Orange. In no event, shall SCP Auctions liability to a purchaser exceed the purchase price of record for the lot.

 

PSA/DNA AUTOGRAPH AUTHENTICATION POLICY

SCP Auctions is committed, with respect to signed material, to selling only items that have been reviewed and authenticated by PSA/DNA. Recent policy changes initiated by PSA/DNA have resulted in SCP Auctions no longer issuing auction letters to serve as letters of authenticity (LOA’s). Instead, PSA/DNA will now issue full letters of authenticity (LOA’s) for specific items in our catalog. All other items will be “Pre-Certified” upon being deemed authentic by PSA/DNA. Please note that it is the responsibility of the bidder to review the lot description for each lot in order to determine what form of authentication will accompany each item. SCP Auctions is not responsible for submitting pre-certified items to PSA/DNA for full LOA’s. Winning bidders may submit their “Pre-Certified” items to PSA/DNA within 60 days of the auction closing with their invoice or proof of purchase from our auction house to receive special pricing from PSA/DNA on upgrading to full letters of authentication (LOA’s). AUTHENTICATION

The provenance and authenticity of the items offered in this sale have been researched extensively. SCP Auctions (formerly SportsCards Plus) has been a leader in the sports cards and memorabilia industry for over thirty years. In many cases, we have employed the services of the foremost independent authentication firms such as PSA or SGC for card grading and authentication services; PSA/DNA (Professional Sports Authenticator), and JSA (James Spence Authentication) for autograph authentication, and MEARS (Memorabilia Evaluation And Research Services) and PSA/DNA (John Taube) for game-used equipment. LOA’s (Letters of Authenticity) from third party authenticators, as well as those from relevant sources, are indicated in the lot description on-line at www.scpauctions.com. AS IS

All property is sold “as is” without any representations or warranties by SCP Auctions or the Consignor as to the merchantability, fitness for a particular purpose, the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature, or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation, or assumption of liability. SCP Auctions and the Consignor make no representations or warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. SCP Auctions and the Consignor are not responsible for errors and omissions in the printed catalogue, on-line catalogue, or any supplemental material or in regards to the failure of the auction program to execute any bids on behalf of the bidder.

 

RETURN POLICY

No certified and/or pre-certified material may be returned due to possible differences of opinion with respect to the grade on any given lot. No guarantee of grade is offered for uncertified property that is later submitted to a third party grading service. Under extremely limited situations a winning bidder may request SCP Auctions to evaluate voiding a sale. The winning bidder must notify SCP Auctions of the alleged error by calling our main office (949) 831-3700 and receive prior approval to return item(s) in question. The winning bidder has three (3) days from receipt of the lot to contact SCP Auctions. Lots under consideration must be sent back to SCP Auctions main office within 30-days once approval has been granted. If the lot(s) are not returned within those 30 days then they are no longer eligible for return. Lots must be entirely intact and in the same condition as when sold to the winner to be accepted and/or considered for return. No amount above selling price will be refunded for any reason. Late remittance for purchases may be considered just cause to revoke all return privileges.

The parties agree to submit any dispute that may arise in connection with the auction to arbitration in Orange County, California. Agreement between bidder and SCP auctions shall be governed and construed in accordance to the laws of the state of California.
